Senator Buruji, ICPC Dragged to Court by Former Legislative Aide

The  Senator representing Ogun East Senatorial District is facing another wave of legal troubles as he is being dragged to court by his former Senior Legislative Aide Hon Onadeko Onamusi over a malicious publication.

Onadeko a Former Member, House of Representatives is citing the publication on page 35 of the Punch Newspaper of the 28th December 2017 in which the Independent Corrupt Practices Commission (ICPC) declared him “Wanted for Fraud”

Onamusi in a statement released via his social media page says the publication is politically motivated and malicious.

The former Rep member added that the said offensive publication was published by the ICPC without him being first invited to its office either by summons or telephone call as provided by Sections 29, 30, 31 and 32 of the ICPC Act.  He said the publication was barely 21 days after he obtained a judgment against the Commission in Suit No: FCT/HC/Cv/2014/17.

According to Onanusi, on the basis of a petition written by an Aide to Senator Buruji Kashamu,  he was arrested by ICPC on 5th May 2017 without any prior letter of invitation or summons in gross violation of Section 29, 30 and 31 of the Corrupt Practices and Other Related Offences Act 2000. As a result of this, he  filed a suit against ICPC for seizing his International Passport and freezing his bank accounts in Suit No:.FCT/HC/CV/2014/17 at the High Court of the Federal Capital Territory in July 2017.

“The Court on the 7th day of December, 2017 in the presence of one Sunny Ezeanu a Principal Legal Officer and Counsel for ICPC delivered a well-considered judgement in Suit No:FCT/HC/CV/2014/17 against ICPC ordering the release of my International Passport, unfreezing of my accounts and a fine of =N=100,000.00 (One Hundred Thousand Naira ) damages to be paid to me” he said.

The Lord Justice A.O.Otaluka in the ruling “observed that investigation into the allegation made against 1st Applicant commenced in May 2017 and by today, 7th of December, 2017, the investigation should have been concluded and there is no evidence before this Court that the Applicants are being tried before any court of law”

Hon Onamusi said he believes the judgement in the above suit infuriated ICPC and their sponsors causing them to come all out against him maliciously,  having already threatened to “deal ruthlessly” with him while he was in their custody on the 5th May, 2017.

The ICPC, said Onamusi,  is yet to obey the Orders of the Honourable Court.

Instead they retaliated by causing a Public Notice to be published at page 35 of the Punch Newspaper of 28th December, 2017 declaring him “Wanted for Fraud”.

He said the said publication is malicious and has greatly maligned his person since he is neither on the run nor a fugitive.

He further added that he has therefore taken out a N500,000,000 (Five Hundred Million Naira) suit against ICPC, Senator Buruji Kashamu and others for defamation of character pending before the High Court of FCT in Suit No: FCT/Cv/0817/18.

A spokesperson for Senator Buruji, Oluwaseunfunmi MacLawrence-Odu’nowo,  commenting under Hon Onamusi’s post on his Facebook page accused Onamusi of allegedly  “allocating and cornering” 18 of 21 Constituency projects to two of his private companies – Stanton Engineering Nigeria Limited and Haines & Baines Ltd. Odu’nowo also questioned how Onamusi could “shortchange a man and his constituents and still have the temerity to sue him for complaining to the appropriate agencies”

Odu’nowo however, in his comments did not say if the accusations were subject to any criminal proceedings or if indeed Onamusi had been questioned for the alleged crimes.

He described Onamusi’s N500,000,000 suit as “no more than an act of braggadocio that will turn round to haunt him
